1. Acceptance of Terms

These Terms of Service (hereinafter: Terms) outline the terms and conditions under which we provide consulting services to non-US citizens seeking to invest in real estate, both within the United States and globally (hereinafter: Client). 

By using the Nonresident Investor (hereinafter: NRI) website and services, you agree to be bound by all Terms we disclose in this document as well as all applicable laws and regulations and you agree that you are responsible for compliance with any local or state laws. We advise you to read the document fully and familiarize yourself with the Terms of Service that govern your use of our site. 

We retain the right to change our Terms at any time, at our own discretion. Therefore, you should consult them regularly, in case there are any changes. By using our site and services, you acknowledge and accept our Terms of Service.

2. Services Offered

NRI provides consulting services to assist non-US citizens in navigating the process of finding, securing, and buying property in the United States for a variety of purposes as chosen by the Client. Our services are provided on an “as-is” and “as available” basis and they include, but are not limited to market analysis, legal guidance, company formation, financial planning, tax compliance advising, banking and financial advising, loan procurement assistance, and advising, and real estate transaction support.

All of the features and options on our website fall under the terms “Services.” We provide these services to our users based on the purchased and paid packages. Any future services, features, or additions will also fall under the definition of “Services,” and will, therefore, be subject to these Terms of Service, unless otherwise explicitly specified.

2.1 Disclaimer

All material and content of the NRI website are created for the purpose of marketing, are owned and licensed by NRI, and should be taken on an “as-is” basis. The NRI does not provide any warranties regarding:

  • Warranties or conditions of merchantability, 
  • Fitness for a particular purpose, or 
  • Non-infringement of intellectual property or other violations of rights.

Furthermore, NRI doesn’t guarantee, warrant, or promise any level of accuracy when it comes to the representations made on the NRI website or any websites linked to it and doesn’t warrant any probable outcomes, reliability of utilization of content acquired on the NRI website or any websites linked to it, or the quality or integrity of information.

All responsibility for the authentication of information and verification of data falls on the website visitors and clients, and NRI takes no responsibility for any and all omissions, inaccuracies, or errors. All information provided on our website is for personal use only, and, therefore, only the website visitor is accountable for their further use.

The services that NRI offers are strictly of advisory nature and NRI doesn’t assume responsibility for, control over, or ownership of the following:

2.1.1. Management of Client’s Finances

NRI unequivocally states that it doesn’t handle any of its Client’s financial means. The company does not assume control, manage, or handle any form of monetary assets belonging to the Client. NRI’s role is strictly advisory, focused on providing comprehensive guidance and expertise in all matters related to real estate investment.

2.1.2. Real Estate Sales

NRI does not engage in the direct sale or brokerage of real estate properties nor is the company an owner of any real estate properties that will later be sold to the Client. The NRI services are centered on the provision of strategic advice that has the goal of empowering clients to make educated decisions regarding real estate investments that will eventually turn them into independent real estate investors. 

2.1.3. Financial Transactions

NRI or any members of its staff will not be involved in any financial transactions related to property acquisition on behalf of the Client. The NRI isn’t a financial intermediary, escrow agent, or transaction facilitator. Clients are responsible for executing their financial transactions independently, in accordance with legal and regulatory requirements.

2.1.4. Property Ownership

The NRI will guide the Client through the entire process of real estate investing, including but not limited to finding, securing, and closing a deal. However, NRI has no ownership or legal interest in the real estate properties acquired by the Client through our consulting services. Clients retain full and exclusive legal ownership of the real estate properties, and NRI assumes no share or stake in the Client’s real property assets. This goes for all properties acquired by the Client through the help of the NRI services, no matter the legal status of the Client, the location of the property, or the strategy employed during the purchasing process. All property the Client bought as a natural person or a legal entity (through a Limited Liability Company) remains solely in the Client’s ownership.

2.1.5. LLC Ownership

As part of its services, NRI offers the service “Company Formation”, which includes forming and legalizing an LLC (a Limited Liability Company) in the Client’s name. In the course of its services, NRI will assist in establishing said Limited Liability Companies (LLCs) for Clients but will never assume ownership, legal stake, equity stake, or control of those legal entities. The ownership of these LLCs remains solely with the Client and the Client assumes complete and autonomous ownership of the LLC entity.

This legal disclaimer aims to provide explicit clarity on the non-involvement of NRI in the handling of the Client’s financial or real estate assets, the sale of real estate, financial transactions, and the ownership of both real estate properties and LLC entities. 

2.1.6. Money Laundering

Money laundering is a serious offense with far-reaching societal implications, giving rise to various criminal undertakings such as drug trafficking, human trafficking, terrorism, and other illicit activities.

In the capacity of a conscientious legal entity, NRI is unwavering in its commitment to impede money laundering and terrorism financing through the implementation of rigorous KYC (Know Your Customer) and AML (Anti-Money Laundering) protocols.

These measures serve to ensure the identification and validation of the identity of all clients, along with the detection of any potential suspicious activities they may be involved in. By identifying potential clients who may be entangled in unlawful pursuits and refraining from providing services to them, we actively contribute to the global fight against financial crime, thereby helping create a more secure marketplace and world for all.

3. Use License

All material and content on the NRI website and created by our software are owned and licensed by NRI. That includes all written and visual content, software, sound recordings, text, logos, videos, graphics, etc. Our users are not permitted to exploit this content, especially for commercial purposes, unless with specific, written consent. Users are not allowed to adapt, copy, distribute, print, publish, etc., any part of the website nor are they allowed to commercialize any information or service obtained on our website or using our services. 

The use of our website and services is available to all our users for their personal, non-commercial use only. Users can also print a copy of any information conceived based on our services, but they may use it in a private, limited matter. Users also aren’t allowed to grant access to their accounts to third parties or share accounts with others.

All clients and website visitors may not:

  • Copy any NRI written or visual content, software, or other materials, nor modify it in any way;
  • Use any NRI written or visual content, software, or other materials for commercial use, public display, or share it with third parties with the intent to commercialize it;
  • Modify any NRI written or visual content, software, or other materials so it no longer includes copyright or other proprietary notions;
  • Transfer or mirror the NRI written or visual content, software, or other materials.

4. Client Responsibilities

Clients are responsible for providing accurate and complete information and all data that is relevant to any real estate investment goals or associated actions as well as any necessary additional documentation. Following the recommendations acquired from the NRI team is essential for a smooth consulting process. 

The Client is responsible for the full payment of the fees and other financial compensation outlined in the agreement between NRI and the Client. All payment terms specified in said agreement must be fulfilled, as failure to adhere to the agreement will result in a suspension of services. 

5. Confidentiality

NRI respects the confidentiality of all client information. We will not disclose confidential information without the client’s explicit consent to any third parties, except as required by law.

 

Confidential information is any information provided by the Client directly or indirectly, in writing, orally, or by inspection of tangible objects (such as documents, data, software, etc.). Confidential information doesn’t include information that:

 

  • Is previously known and generally available to the public,
  • Becomes publicly known or generally available to the public,
  • Is already in possession of NRI. 

6. Limitation of Liability

NRI, all vendors the Client makes a connection with through NRI, and all suppliers connected to NRI are in no way liable or responsible for any direct, indirect, incidental, consequential, or punitive damages arising out of the use of the NRi services or the inability to use the NRI services or services from third-parties that NRI assists the Clients in using.

All materials and content on the NRI website are of informational nature and the NRI doesn’t take responsibility or warrant the accuracy, reliability, integrity, or quality of materials on the NRI website nor of the materials included in the websites linked to the NRI website.

All NRI materials could include errors (technical, photographic, factual, or typographical ones) and NRI reserves the right but offers no promise to modify, include, or exclude all materials contained on the NRI website at any time, with no notice to the website users. 

The NRI team is not responsible for the contents of any third-party websites linked to the NRI website and the use of said websites is at the website visitor’s risk.
